Noutati referitoare la aplicarea legii 221 / 2009
privind condamnarile cu caracter politic…


Speriusi-Vlad &Sarafolean (SVS-Partners), asociatie profesionala de avocati a atacat la Curtea Constitutionala prevederile Ordonantei de urgenta a Guvernului nr. 62/2010 prin care se limiteaza cuantumul despagubirilor (la cate  2.500, 5.000 sau 10.000 euro in functie de calitatea reclamantului) acordate conform legii 221/2009 privind condamnarile cu caracter politic si masurile administrative asimilate acestora, pronuntate in perioada 6 martie 1945-22 decembrie 1989. Conform textului ordonantei, aceste prevederi ar urma sa se aplice retroactiv, adica sa limiteze acordarea despagubirilor chiar si in procesele in care s-au pronuntat hotarari judecatoresti dar care nu au ramas definitive si desigur pentru toate actiunile deschise chiar anterior intrarii in vigoare a OUG nr.62/2010.

 
Initial textul de lege nu prevedea un plafon maxim al despagubirilor, instanta fiind cea care urma sa decida in functie de particularitatile cazului asupra sumei acordate.
 
Motivele pentru care in numele si in interesul legitim al clientilor pe care ii reprezentam am inaintat o exceptie de neconstitutionalitate tin in primul rand de principiul neretroactivitatii legii, de inexistenta in fapt al acelei pretinse situatii extraordinare care sa permita luarea acestei masuri prin ordonanta de urgenta, si nu in ultimul rand de incalcarea drepturilor si libertatilor fundamentale,” explica Tiberiu Sarafolean, partener fondator al Speriusi-Vlad & Sarafolean.
 
In cateva cazuri anterioare, in prima instanta, tribunale au acordat unor fosti detinuti politici sume cuprinse intre 100.000 si chiar 200.000 de euro, in functie de perioada de detentie. “Exista insa o practica generalizata ca toate aceste sentinte favorabile, indiferent de cuantumul acordat sa fie atacate de catre Ministerul de Finante, prin intermediul Directiilor judetene din subordine”, avertizeaza Tiberiu Sarafolean.” Din acest motiv, pana in momentul de fata nici una dintre hotarari nu este definitiva si nu a fost pusa in executare”.
 
Avocatul Poporului a ridicat deasemnea, in fata Curtii Constitutionale exceptia de neconstitutionalitate privind dispozitiile Ordonantei de urgenta a Guvernului nr. 62/2010 prin care se limiteaza cuantumul despagubirilor acordate conform legii 221/2009 privind condamnarile cu caracter politic si masurile administrative asimilate acestora, pronuntate in perioada 6 martie 1945-22 decembrie 1989. Exceptia se intemeiaza pe art 115 alin. (6) din Constitutie care stipuleaza ca ordonantele de urgenta nu pot Ordonanţele de urgenţă nu pot fi adoptate în domeniul legilor constituţionale, nu pot afecta regimul instituţiilor fundamentale ale statului, drepturile, libertăţile şi îndatoririle prevăzute de Constituţie, drepturile electorale şi nu pot viza măsuri de trecere silită a unor bunuri în proprietate publică.



Under Speriusi-Vlad &Sarafolean Partners litigation, the court may admit 2.2 million rights to a group of researchers of the former Solventul communist chemical plant. The group employees invented a technique that produces 2-ethilhexanol by continuous reactivity of the hydrogenation catalyser. The invention increased productivity and a prolonged operating time for machinery, saving tens of million for the company .

“Also, the invention of the employed researchers, meant no more similar components had to be imported from an exclusive and highly expensive Western manufacturer”
, acknowledges Alin Speriusi , founding partner of the Timisoara based law-firm. The former company that operated the chemical plant filed for insolvency at the end of the ‘90s, with all types of creditors lining up to collect a very heterogeneous array of dept. It registered the invention in 1994 with the Romanian State office for Inventions and Trademarks, but failed to meet its contractual requirements to the team of inventors. “It is one of the rare cases in Romania, however, that intellectual property rights originating in inventions by workers during the communist regime are acknowledged by court. But it is certainly a novelty that IP rights in such large amounts are admitted with equal importance during liquidation procedures”, says Alin Speriusi.

The insolvency procedures for the former mastodon chemical plant that exported to all former Eastern economic block countries, were started 13 years ago. Following the sale of its real estate, Solventul is now in a position to cover its massive dept. These intellectual property rights related dues are estimated some 5-7 % of its total current liquidities.
